The rationale behind the creation of the post of legal advisor to the ministry is based on Article 145 (2) of the Federal Constitution which states:-

 Article 145. Attorney-General

(2). It shall be the duty of the Attorney-General to advise the Yang di-Pertuan Agong or the Cabinet or any Minister upon such legal matters, and to perform such other duties of a legal character, as may from time to time be referred or assigned to him by the Yang di-Pertuan Agong or the Cabinet, and to discharge the functions conferred on him by or under this Constitution or any other written law.

The legal advisor serving in the ministry is a special representative of the Attorney-General whose general function is advice the ministry on legal matters. Therefore, the presence of the legal advisor of the ministry is to discharge the duties of the Constitution as explicitly stated under Article 145 (2) of the Federal Constitution.

  • Provide quality legal advice to the Ministry and its departments, agencies and divisions within fourteen (14) working days from the date of receipt of complete documents and information.
  • To review and examine existing major or subsidiary legislation within 40 days after all legal and policy issues are resolved.
  • To examine contract/agreement documents belonging to departments/divisions and agencies under the Ministry within 14 days from receipt of complete documents.
  • To review and provide direction on investigation papers under Acts related to the Transport Ministry within 14 days.
  • To represent the Government of Malaysia and the Ministry in civil litigation matters on the date, time and place as directed by the Attorney-General.
  • To advise Ministry on matters referred to all aspects of law except on international law and Islamic law.
  • To assist the Ministry in interpreting law, when requested.
  • To draft or revise law documents such as legal notices, agreements and memorandum of understanding where it includes the Government as one of the parties in order to protect the interests of the Government..
  • To conduct research on issues of laws
  • To participate in treaty negotiations in respect of Government projects involving the Ministry.
  • To attend meetings and advise on laws relating to decisions made to ensure it is made in accordance with the law.
  • To attend Parliament when it is in session to assist in legal issues when needed.
  • To advise the Ministry of Transport and its agencies on legal matters.
  • To handle legal matters that is referred from time to time.
